Terms of Service

Preamble
These Terms of Service (hereinafter "ToS") govern access to and use of the Wowiin APP application, published by Mon CGP SAS, a Simplified Joint Stock Company (Société par Actions Simplifiée) with a share capital of €1,000, registered with the Paris Trade and Companies Registry under SIREN number 880 295 696, with its registered office at 49, rue de Ponthieu — 75008 Paris (hereinafter "Wowiin" or "we").
By creating an account on Wowiin APP, you unreservedly accept these ToS. If you do not accept their terms, you must not use the service.
Article 1 — Definitions
"Service": the Wowiin APP web application accessible at wowiin.app, including all its features.
"User": any adult natural person who has created an account on Wowiin APP.
"Subscriber": a User who has subscribed to a paid plan (Monthly, Semi-Annual, or Annual).
"User Content": any data, information, or file submitted or uploaded by the User when using the Service.
"AI Concierge" or "IAC" (Contextual Artificial Intelligence): the AI-assisted response service offered to Subscribers.
"Security Alerts": the security alert service aggregating information from official consular and institutional sources, available to paying Subscribers.
Article 2 — Access to the Service
2.1 Access conditions
Use of Wowiin APP is reserved for adult natural persons with legal capacity to enter into contracts. By creating an account, you declare that you have the legal capacity to accept these ToS.
2.2 Account creation
Users create their account by providing a valid email address and a password meeting the security requirements displayed. Access to the Service is conditional on email address verification. Users are solely responsible for keeping their login credentials confidential.
2.3 Availability
No availability guarantee is given for version 1 of the Service. Wowiin shall not be held liable for service interruptions, regardless of their cause or duration.
Article 3 — Subscription plans and pricing
3.1 Available plans
Wowiin APP offers four plans: Free Plan, Monthly Plan, Semi-Annual Plan, Annual Plan. The prices, quotas, and features associated with each plan are those displayed on the pricing page (wowiin.app/pricing) at the time of subscription.
3.2 Billing and payment
Payment is processed via Stripe. Bank card data does not transit through Wowiin’s servers. Paid plans are billed in advance at the time of subscription.
3.3 Renewal and cancellation
The Monthly Plan renews automatically at expiry, unless cancelled by the Subscriber before the renewal date. Subscribers may cancel their subscription at any time. Cancellation takes effect at the end of the current subscription period.
Article 4 — Right of withdrawal and refund policy
4.1 Right of withdrawal — general rules
Under Article L.221-18 of the French Consumer Code, consumer Users have a withdrawal period of fourteen (14) days from the conclusion of the subscription contract.
4.2 Express waiver of the right of withdrawal
Under Article L.221-28(13°) of the French Consumer Code, by subscribing to a paid plan on Wowiin APP and requesting immediate access to the Service’s features, the Subscriber expressly acknowledges waiving their right of withdrawal from the moment the subscription is effectively activated. This waiver is collected expressly during the subscription process.
As a result, no refund will be issued once the subscription has been activated, regardless of the actual duration of use of the Service during the subscribed period.
4.3 Exceptions
The no-refund policy does not apply in the event of total and prolonged failure of the Service attributable solely to Wowiin, or a manifest billing error. In these exceptional cases, the Subscriber may contact admin.wowiin-app@moncgp.fr.
Article 5 — Use of the Service and User obligations
5.1 Personal and non-commercial use
The Service is intended for strictly personal use. Users agree not to use Wowiin APP for commercial purposes.
5.2 Prohibited uses
The following are strictly prohibited: attempting to access without authorization other Users’ accounts or Wowiin’s IT systems; uploading files containing viruses or malware; using the Service for unlawful purposes; circumventing quota mechanisms or access controls; reproducing or commercially exploiting any element of the Service without prior written authorization.
5.3 Responsibility for uploaded files — prohibition on uploading sensitive data
It is strictly prohibited to upload documents containing highly sensitive personal data beyond what is strictly necessary for managing your trips — including, by way of non-exhaustive example, biometric data, detailed health data, bank statements, data relating to legal proceedings, or any document whose disclosure could cause serious harm to its holder.
Users are solely responsible for the files they upload to Wowiin APP and warrant that they comply with this prohibition. Wowiin does not monitor the content of uploaded files and accepts no liability for damage resulting from non-compliance with this rule.
Article 6 — Intellectual property
6.1 Wowiin’s rights
All elements constituting Wowiin APP — software, texts, graphics, trademarks, databases — are the exclusive property of Mon CGP SAS or are used under licence. Any unauthorized reproduction or use is prohibited.
6.2 User Content
Users retain full ownership of the User Content they submit or upload. By using the Service, they grant Wowiin a limited, non-exclusive, non-transferable licence, solely for the purpose of providing the Service.
Article 7 — Deletion of documents upon subscription expiry
Upon the expiry or cancellation of any paying subscription, files uploaded by the Subscriber are deleted immediately and automatically from our servers. This deletion is permanent and irreversible.
It is the Subscriber’s responsibility to download and retain a copy of their files before their subscription expires. Wowiin shall not be held liable for the loss of files resulting from the expiry or cancellation of a subscription.
Article 8 — Limitation of liability — General Service
8.1 Nature of the Service
Wowiin APP is a travel planning assistance tool. The information presented is provided for informational purposes only.
8.2 Information provided by the AI Concierge
Responses generated by the AI Concierge are produced by an artificial intelligence system. They may contain inaccuracies, omissions, or outdated information. Wowiin does not guarantee the accuracy, completeness, or suitability of these responses to the User’s particular circumstances. Users are expressly invited to verify any information provided by the AI Concierge with the relevant official sources before making any decision.
8.3 General liability
To the fullest extent permitted by applicable law, Wowiin shall not be held liable for any direct or indirect damage resulting from the use of or inability to use the Service.
Article 9 — Specific limitation of liability — Security Alerts Service
9.1 Nature and scope of the Security Alerts service
The Security Alerts service aggregates information from official consular and institutional sources of third countries — including the French Ministry for Europe and Foreign Affairs (France Diplomatie), the UK Foreign, Commonwealth & Development Office (FCDO), the US Department of State, the German Federal Foreign Office (Auswärtiges Amt), Global Affairs Canada, as well as the Global Disaster Alert and Coordination System (GDACS, UN/European Commission) and the United States Geological Survey (USGS) for seismic alerts.
Wowiin acts exclusively as an aggregator of publicly available official information, and not as a primary alert or reference service. The Security Alerts service is complementary to the official tracking mechanisms available to nationals (Fil d’Ariane for French nationals, STEP for US nationals, Travel Aware for UK nationals, etc.) and is in no way a substitute for them.
9.2 No warranty
Information transmitted via Security Alerts is provided for strictly informational purposes only, with no warranty whatsoever as to completeness, accuracy, timeliness of transmission, or suitability to the Subscriber’s particular circumstances.
Expressly and without limitation:
• Wowiin assumes no obligation of means or result with regard to the detection, processing, or delivery of security alerts.
• Information sources are independent institutional third parties. Wowiin is not responsible for their availability, the accuracy of their data, their publication timelines, or any unilateral modification of their content.
• Wowiin shall not be held liable for any security event that was not detected, was detected late, or whose transmitted information was misinterpreted by the Subscriber.
• Detection of a security alert concerning a destination does not imply any obligation on Wowiin’s part to inform the Subscriber beyond the alerts actually transmitted on the basis of available data.
9.3 Subscriber’s responsibility
Subscribers retain full responsibility for consulting official and institutional sources directly, both before and during any trip. Information received via Security Alerts shall not substitute for such direct verification.
Activation of Security Alerts does not exempt Subscribers from taking out travel insurance appropriate to their needs, or from registering with the official national tracking systems established by their country of nationality.
9.4 Prior consent
The Security Alerts service is activated only for Subscribers who have given their explicit consent during onboarding. This consent may be withdrawn at any time from account settings, without such withdrawal giving rise to any right to a refund.
Article 10 — Account suspension and termination
Wowiin reserves the right to suspend or terminate, without notice or compensation, the account of any User who violates these ToS, uses the Service for unlawful or fraudulent purposes, or compromises the security or proper functioning of the Service.
Users may terminate their account at any time from their settings. Termination results in the permanent deletion of their data in accordance with the Privacy Policy, after a grace period of thirty (30) days.
Article 11 — Amendments to the ToS
Wowiin reserves the right to amend these ToS at any time. In the event of a material change, Users will be notified by email at least thirty (30) days before the new ToS take effect.
Article 12 — Governing law and jurisdiction
These ToS are governed by French law. Any dispute relating to their interpretation or performance falls under the exclusive jurisdiction of the competent courts of Paris, unless mandatory legal provisions applicable to consumers residing in another EU Member State provide otherwise.
Article 13 — Consumer dispute resolution
In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, Mon CGP SAS is required to offer a mediation procedure to its consumer clients. In the event of a dispute not resolved following a prior complaint submitted to admin.wowiin-app@moncgp.fr, the User may refer the matter to a consumer mediator.
Designated consumer mediator: appointment in progress. Mon CGP SAS is in the process of selecting a registered mediator in accordance with Articles L.613-1 et seq. of the French Consumer Code. This information will be updated upon effective appointment.
